Terms and conditions

The General Sales Terms and Conditions (hereinafter, “GSTC”) are hereinafter set forth, governing the contractual relationship whose purpose is the sale of products offered from the website www.invictusapparel.es, owned by Gm2 Distribución SL (hereinafter, “Gm2”), with registered office at Correria 124, Vitoria, 01010, VAT ID B01499458, and the natural or legal persons (hereinafter, “customer”) who express their intention to purchase such products through the request made via the Internet through this website. The customer’s request constitutes the specific conditions to which these GSTC are associated, which the customer must consult prior to purchasing the product. These GSTC are presented to the customer through the website www.invictusapparel.es so that they may read, print, file and accept them, and the customer may not purchase the product without such consultation. The customer will always have these GSTC in a visible and freely accessible place on the website. These GSTC together with the request for the specific products made by the customer imply the formalization of the purchase agreement between Gm2 and the customer, who affirms:

  • a) Having read, understood and accepted these General Contracting Conditions.
  • b) Being of legal age and with full capacity to contract.

Applicable legislation and modification of the GSTC
These GSTC are subject to the provisions of Law 7/1998 of 13 April on General Contracting Conditions, Law 26/1984 of 19 July, General for the Defense of Consumers and Users, Royal Decree 1906/1999 of 17 December 1999 regulating Telephone or Electronic Contracting with general conditions, Organic Law 15/1999 of 13 December on the Protection of Personal Data, Law 7/1996 of 15 January on Retail Trade Regulation, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce. Gm2 reserves the right to modify these GSTC at any time, without prior notice to the customer, who in any case is solely responsible for reviewing them as a prior and essential requirement to the acquisition of any product available through the Gm2 website. In any case, the GSTC displayed on the website at the time the customer acquires the corresponding products shall be considered valid and applicable.

Shipping

Delivery times vary depending on the product and size. When you select a size you will see an approximate delivery or dispatch time. To that we will add:

For shipments to mainland Spain (Iberian Peninsula), the information shown indicates the working days in which the order will be delivered to the address. Normally 48 hours maximum, as our commitment is to use EXPRESS courier service for shipping. Shipments to CANARY ISLANDS, CEUTA AND MELILLA have a minimum delivery time of 2 weeks and may be subject to customs charges.

Delivery times may vary between 1 and 2 weeks. If there is any stock shortage or temporary unavailability, we will inform you immediately and give you a new delivery time, or if it is not possible to supply the product, we will proceed to cancel and refund it.

In all cases we reserve the right to send to a pickup point of the courier company so that you may collect your parcel, in order to avoid that you are not at home.

Delivery or warehouse dispatch times are indicative, and in any case, a delay in delivery with respect to the indicated times will not entitle the customer to claim any compensation.

Shipments within the EU will take between 4 and 5 working days, and may also experience variations of up to 1 or 2 weeks, especially during periods of extreme e-commerce activity (Christmas, Black Friday).

NO SHIPMENTS ARE DISPATCHED FROM FRIDAY 13:00 UNTIL SUNDAY.

WE DO NOT IN ANY CASE COVER CUSTOMS CHARGES

Returns

FREE SIZE EXCHANGE (SPAIN/PORTUGAL)

Size exchange will be completely free for purchases made in Spain (Mainland and Balearic Islands) and Portugal that exceed 99 euros. The promotion is not valid for the Canary Islands, Ceuta, Melilla, Azores and Madeira. It is important to note that only one size exchange process will be allowed per order. Change of color or model of the product is excluded from this promotion and will entail the usual costs of 10 euros plus the difference in product price.

Withdrawal

The customer has 14 calendar days to exercise the right of withdrawal. The refund to the customer’s account will be made as soon as possible after Gm2 receives the goods. Withdrawal will result in a refund that includes the price of the product and the shipping costs invoiced, but does not include any delivery costs from the customer to Gm2.

  • The product must be in perfect condition and, as far as possible, with its original packaging and original labelling; otherwise the product will suffer a depreciation that the customer will have to assume. The return cannot take place in any case if the supplied products were manifestly used. The product must not show writing, stickers or packing tape.
  • The product must keep all accessories with which it was supplied that are proper to the brand.
  • The return number must be clearly written on the outside where the shipping address is indicated.

Conditions for refunding the amount:

If a refund is requested, the maximum period to request the return shall be 14 working days from the date of receipt of the order. The refund will be made using the original payment method, whenever possible.

Spain/Portugal

The costs incurred for transport, which will not be refunded, are subject to the following conditions:

 

  • If the original order was less than 60 euros, only the amount of the items will be refunded.
  • If the original order was greater than 60 euros, an amount of 6 euros will be deducted. The refund, in this case, will be made via bank transfer or PayPal.
  • For orders shipped to Balearic Islands:
  • If the original order was less than 60 euros, the amount to be deducted upon refund will be 12 euros.*
  • If the original order was greater than 60 euros, the amount to be deducted will be 15 euros.*

*The indicated amounts include the costs of shipping the order to the customer’s address and the return shipping costs to our headquarters.

  • For orders shipped to Canary Islands**, Ceuta**, Melilla**, Azores and Madeira: please consult.

 

European Union

For orders shipped to the European Union (except the territories mentioned above), the cost of the return label by UPS will be €35; you may also send the product on your own and the full amount of the returned product(s) will be refunded.

If you chose the “Return and Exchange Insurance”, the full amount of the order will be refunded. The insurance amount will not be refunded in any case.

Countries outside the European Union**: please consult.

**For Canary Islands, Ceuta, Melilla and countries outside the European Union, customs charges that may have originated will not be refunded either.

 

Warranty

The warranty offered is the European standard 2-year warranty. To process it, photographs will be needed. From 6 months onwards, the customer must send the helmet at their own cost to our facilities to determine whether the failure is caused by misuse; otherwise it will be returned repaired or replaced with a new one, plus a €10 discount on the next purchase to compensate for shipping costs. The warranty does not cover damage caused by use or falls.

Jurisdiction and Competence
These General Conditions are governed by Spanish law. “The parties submit, at their option, for the resolution of disputes and waiving any other jurisdiction, to the courts and tribunals of Vitoria.
